The General Administration of Customs (GAC) recently promulgated the Measures of the PRC for the Customs Administration of Inbound and Outbound Means of Transport, which apply to the customs administration of operational inbound and outbound means of transport, and may also be taken as a reference in the administration of non-operational inbound and outbound means of transport. The Measures provide that, unless otherwise approved by the State Council or any organ authorized by the State Council, any inbound or outbound means of transport shall not enter or leave the country unless the entry or exit has been subject to customs clearance, and any inbound or outbound means of transport shall only stop, handle goods or articles or load or unload persons at the customs-controlled premises. The Measures also make it clear that any outbound means of transport for entry or vice versa without a customs clearance or payment of tariffs shall not be transferred or used for other purposes.
