Under this law, the HKSAR shall establish the Committee for safeguarding National Security. How do we understand its role?


The promulgation and implementation of the Hong Kong National Security Law has opened a major turning point in Hong Kong from chaos to governance. The National Security Law of Hong Kong is not a decoration. It must be effective. It must have strong enforcement mechanisms and must have a grasp. The establishment of the National Security Agency in Hong Kong is a major measure taken by the central government to fulfill its fundamental responsibility for safeguarding national security, and it is a powerful hand that the National Security Law of Hong Kong can effectively apply. As an agency of the Central People’s Government, the National Security Office in Hong Kong and the relevant agencies of the Special Administrative Region carry out their work in accordance with the duties stipulated by the Hong Kong National Security Law, which together constitute the implementation mechanism of the Hong Kong Special Administrative Region to maintain national security, and jointly perform the constitutional responsibility of maintaining national security to ensure that Relevant laws are in place and effectively implemented.


The legitimacy and legitimacy of the National Security Agency in Hong Kong lies in: First, national security belongs to the central authority. Judging from the general rule of law in various countries in the world, the country must set up corresponding direct law enforcement agencies at the local level to match the actual needs of national security enforcement and better maintain National Security;


Second, the Hong Kong SAR enjoys certain national security legislative and law enforcement powers in accordance with the Basic Law and the Hong Kong National Security Law. However, the acquisition of these powers is based on a high degree of trust from the central government. At the same time, its law enforcement capabilities also have local limitations. Providing strong support from national forces is the most powerful legal aid for the SAR agencies;


Third, the special jurisdiction of the central government agency in Hong Kong is highly controlled. According to the principle of necessity, it only covers those cases that exceed the limits of the law enforcement capabilities of the SAR, may have a foreign-related cross-border background, and are particularly harmful to national security. Jurisdiction can avoid the system risk of Hong Kong’s insufficient law enforcement force causing direct jump to apply the emergency provisions of Article 18 of the Basic Law;


Fourth, the direct jurisdiction and relevant investigative powers of the resident agencies in Hong Kong can form an unprecedented strong deterrent to Hong Kong’s extreme local forces and external intervention forces, which can prevent and stop destructive illegal activities and activities to the greatest extent, and consolidate the rule of law in Hong Kong And prosperous and stable long-term maintenance to provide institutional protection;


Fifth, the Hong Kong institution is not an institution established by the central authority referred to in Article 22 of the Basic Law, but an institution directly authorized by the central government to deal with national security affairs. It does not require the approval of the SAR government and the registration of the laws of the SAR. According to law, enjoy the exemption and convenience commensurate with its status, thus becoming the fourth agency of the central government in Hong Kong (the first three are the Hong Kong Central Liaison Office, the Ministry of Foreign Affairs Office in Hong Kong and the People’s Liberation Army in Hong Kong);


Sixth, the National Security Office in Hong Kong has various responsibilities for collecting national security intelligence, formulating and maintaining national security policies, and supervising, guiding, coordinating, and supporting local law enforcement agencies in Hong Kong. Therefore, it requires corresponding legal authorization, law enforcement personnel, and technical equipment. And strong policy research, intelligence analysis and on-site law enforcement capabilities in order to adapt to the relatively complex and more challenging national security law enforcement environment in Hong Kong society.
