According to WIKIPEDIA, a blasphemy law is a law prohibiting blasphemy, which is irreverence or insult toward holy personages, religious groups, sacred artifacts, customs, or beliefs. Currently, China does not have such kind of separate laws or regulations.
China is rich in land, large in population, and China is also a multi-religious country. Taoism, Buddhism, Islam, Catholicism, Protestantism and Confucianism are the most widely spread religious in China, and there are a few other religions and different folk beliefs in some local areas. The Constitution confers Chinese citizens the freedom of religious belief, which is also guaranteed by other laws and regulations.
Being as the fundamental law of the country, Article 36 of the Constitution specifies that:
“Citizens of the People’s Republic of China enjoy religious freedom.
No state institution, public organization, or individual may compel citizens to adhere to, or not to adhere to, any religion; nor may they discriminate against citizens who adhere to, or do not adhere to, any religion.
The state safeguards normal religious activities. No one may make use of religion to engage in activities that are disruptive to the public order, that cause harm to the health of citizens or that interfere with the educational system of the state.
Religious organizations and religious affairs are not subject to foreign control.”
For the purpose of better protecting citizen’s freedom of religious belief, maintaining the harmonization of different religious and the social environment, regulating the management on religious related matters in order and improving the legalization level of the religious works, the State Council issued the Regulations on Religious Affairs in 2004 (“Regulations”), and after twice revisions, the newly revised Regulations on Religious Affairs took effect on February 1, 2018. Such Regulations provide that Religious and non-religious citizens and citizens of different religions should respect each other and live in harmony; No organization or individual shall create contradictions or conflicts between different religions, within the same religion or between religious and non-religious citizens, shall not preach, support or finance religious extremism and may not use religion to undermine national solidarity, national unity or terrorist activities; Publications involving religious content shall conform to the provisions of the State Administration of Publication and shall not contain any content that undermines harmony between religious and non-religious citizens, undermines harmony among different religions and inter-religious harmony, or discriminates against them or insults religious or non-religious citizens.
In addition, in order to guarantee the foreign visitors’ freedom of religious belief within the territory of China and maintain the public interest of the society, the State Council also issued and implemented the Provisions of the people’s Republic of China on the Administration of Foreign Visitors’ religious activities and its Implementation Rules to better respect the foreign visitors’ religious belief, protect and manage their religious activities in China and the friendly exchanges and cultural and academic exchanges between the foreign visitors and Chinese religious society.
Besides, a number of laws and regulations in China also clearly reflect the requirement to abide by the good customs of the national society. Article 8 of the General Rules of the Civil Law of the People’s Republic of China states that: “No civil subject engaging in civil activities may violate laws or go against the public order and good morals.”
Article 10 further provides: “Civil disputes shall be resolved in accordance with the law; where no relevant provision is prescribed by laws, customs may apply, without violation of the public order and good morals.”
Article 40 of the Measures for the Administration of Lawyers’ Practice requests that: “Lawyers should objectively, impartially and prudently make public statements on cases in accordance with law and shall not publish or disseminate any statement which objects the fundamental political system or basic principles established by the Constitution or endangers national security, shall not use the internet or any media to incite dissatisfaction with the Party and government, shall not initiate or participate in organizations or support any organization or participate in any activity which endangers national security, and lawyers shall be refrained from making malicious statements or slander against others or making any statement that seriously disrupt the order of the court by way of distorting the truth of the facts and obviously violating the public order, good customs, etc.”
Article 4 of the Administrative Measures for Online Trading requires that: “Anyone engaging in online commodity trading and related services shall follow the principles of voluntariness, fairness and honesty and credibility, and shall observe business ethics and public order and good customs.”
