Foreign Employees’ Participation In Social Insurance Measures Issued For Consultation

The Ministry of Human Resources and Social Security released the “Interim Measures for the Participation in Social Insurance by Foreign Employees in China (Consultative Draft)” on the website of the Legislative Affairs Office for public consultation by 17 June 2011. The Consultative Draft sets out provisions with respect to the applicable scope, social insurance treatment, overseas living authentication and dispute settlement for foreign employees who participate in social insurance in China. Under the draft, any employing entity which employs foreign employees should handle their social insurance registration in accordance with the law. For any foreign employee who is dispatched to work for a local entity by his overseas employer, the local entity in China should handle the social insurance registration for him.
