The National Tourism Administration has recently published the Compensation Standards for Service Quality of Travel Agencies (Consultative Draft) to consult the public from 10 November 2010 to 17 November 2010. The Standards provide that where a travel agency forces, or forces in any disguised form, any tourist to buy any commodity, such travel agency shall pay 20% of the total travel expenses to the tourist as a penalty. Where a travel agency transfers any tourists to another group or puts together any tourists into a group without such tourists’ consent, and such tourists are informed of the same before the departure (exclusive of the date of departure), such tourists have the right to rescind their contracts and the travel agency shall fully refund the travel expenses that have already been paid by such tourists, and pay 15% of their total travel expenses as a penalty; where such tourists are informed of the same on or after the date of departure, the travel agency shall pay 25% of their total travel expenses as a penalty.
