Interim Provisions on the Administration of Intellectual Property of Major National Science and Technology Projects has been released

As an effort to better implement the Major National Science and Technology Projects, the Interim Provisions on the Administration of Intellectual Property of Major National Science and Technology Projects has been released by the Ministry of Science and Technology (MOST), together with the National Development and Reform Commission (NDRC), the Ministry of Finance (MOF), and the State Intellectual Property Office (SIPO) on July 17th 2010.

Based on the Law of the People’s Republic of China on Scientific and Technological Progress and the Outline of the National Intellectual Property Strategy, the Provisions cover general provisions, duties for the administration of the IP, the administration of the IP in the implementation of the major special projects, attribution and protection of the IP and IP transformation and application.

“Major National Science and Technology Projects of China is an important strategic decision oriented toward a new age of independent innovation and long-term development,” comments Edward E. Lehman, Managing Director of Lehman, Lee & Xu. “In accordance with it, the enhancement of intellectual property management which the Provisions aim at is of vital importance.”
